In Kentucky the statute of limitations for a medical malpractice claim is one year from the date of the alleged malpractice practice, or one year from the date of the discovery of the malpractice. For example, if a person has a surgical procedure and for eighteen months has pain in his abdomen, and it’s only then that it’s discovered a surgical instrument was left inside him, his statute of limitations might begin to run from the date the discovery of that problem, not from the date of the actual surgical error.
