A wrongful death claim is a claim that’s brought by the estate of the deceased person. What generally has to happen is once a person passes away as a result of a negligence or carelessness of another person or company, we have an individual appointed representative over that deceased person’s estate. If there’s a will it’s called an executor, if there’s no will that person’s called an administrator.
We have one year generally from the date that person’s appointment to file a wrongful death suit. Wrongful death claims generally compensate the estate for that person’s loss of earning potential to the estate and any proceeds derived from the lawsuit or the claim go to the beneficiaries of the estate, generally the heirs, any surviving spouse and children.
